Spector Caldes & Corrigan Secures Proposed $10 Million Settlement in Infant Formula Antitrust Litigation

October 23, 2026 — Spector Caldes & Corrigan PC, serving as interim co-lead counsel, has helped secure a proposed $10 million settlement with Perrigo Co. PLC, L. Perrigo Company and PBM Nutritionals, LLC (collectively “Perrigo”) in a consumer antitrust class action alleging an anticompetitive agreement between Perrigo and Gerber Products Company that maintained a monopoly in the store-brand infant formula market.

The proposed settlement, currently pending approval in the U.S. District Court for the Eastern District of New York, provides monetary relief to consumers nationwide who purchased store-brand infant formula manufactured or sold by Perrigo from a retailer for personal use between April 2020 and the present.

In addition to the monetary settlement, Perrigo has agreed to refrain from entering into certain anticompetitive agreements for three years and to cooperate with plaintiffs in their ongoing litigation against Gerber, including providing documents, transaction data, and witness testimony.

Notably, plaintiffs’ counsel are not currently seeking attorneys’ fees or service awards for the class representatives from the settlement fund, although the agreement provides for reimbursement of certain litigation expenses, subject to Court approval.

Spector Caldes & Corrigan attorneys Jeffrey J. Corrigan and Jeffrey L. Spector represent the plaintiffs alongside co-counsel Saltz Mongeluzzi Bendesky PC.

The case is Conry et al. v. Gerber Products Co. et al., Case No. 1:24-cv-06784, pending in the U.S. District Court for the Eastern District of New York.
